Question: Can we use Overflow’s donation platform as an international nonprofit? 

Answer: It depends on the asset!

As an international nonprofit, you can use Overflow if you have ONE of the following:

  1. A 501(c)(3) equivalency organization registered in the U.S.
  2. A U.S.-based fiscal sponsor with a 501(c)(3) designation
  3. A U.S. based organization with an established EIN
  4. A U.S. based partner organization

 

What is a 501(c)(3) equivalency organization?

If your nonprofit organization is based outside of the U.S., you can create a U.S. “Friends of” organization for the purpose of raising funds in the U.S. that will ultimately be distributed to the foreign charity they are connected with. “Friends of” organizations should be organized to meet the legal requirements for contributions to be deductible for U.S. tax purposes, (i.e. they are public charities with a 501(c)(3) designation).

 

What is a U.S. based fiscal sponsor?

A fiscal sponsor is a nonprofit organization that provides fiduciary oversight, financial management, and other administrative services for charitable organizations and projects. A fiscal sponsor can facilitate the solicitation and receipt of donations from within the U.S. and around the world. The fiscal sponsor’s 501(c)(3) status allows your international organization to apply for and receive grants and establish donations as tax deductible.


What is a U.S. based organization with an established EIN?

If you had an established EIN set up in the U.S. this would allow your donors to submit shares of stocks through that organization. We would liquidate those shares and then deposit the funds into the bank account established in the U.S. 

 

What is a U.S. based partner organization?

If you have an organization that you partner with based in the U.S., we could set up a Stock URL on their website and the donor would select your church/nonprofit as the campaign type.
